These Terms of Service explain how Speak2mail works, how credits and subscriptions are handled, and what you can expect when using our AI-powered email writing tool.
Using Speak2mail Means Accepting These Terms
These Terms of Service (the “Terms”), in conjunction with our Privacy Policy, constitute the entire Agreement between Trifon Sheikin (Sole Proprietor Business) (“Trifon Sheikin”, “we”, “us”, or “our”) and you (“you”, “your” or the “User”). These Terms govern your use of the speak2mail.com website, the Speak2mail Chrome extension, and/or the Speak2mail services (collectively, the “Service”).
By using our website or Chrome Extension, you agree to comply with the conditions outlined below. Each visit to our site or use of our services constitutes acceptance of these terms, so please review them carefully. We may update these Terms of Service from time to time. If we make material changes, we will provide you with reasonable prior notice (e.g., by email or in-app notification). If you do not agree to the updated Terms, you may stop using the services before the changes take effect. Non-material updates take effect upon posting.
Communications
You acknowledge and agree that we may send you emails related to your account and/or the Service.
Intellectual Property
We claim no intellectual property rights over the data you provide to the Service. You acknowledge and agree that we own all right, title, and interest in and to the Service, including without limitation all intellectual property rights. You agree that you will not copy, reproduce, alter, reverse engineer, clone, or modify the Service or create derivative works from the Service.
Use License
Speak2mail offers both a free service option with limited credit amount and paid options that provide access to an extended set of features and credits. The specifics of these features for each plan can be found on our pricing page.
License Grant
Upon purchasing a subscription or one-time credits, Users are granted a limited, non-exclusive, and non-transferable license to access and use Speak2mail’s premium features. The license is assigned to a single user account or team associated with the purchaser. Subscription credits renew automatically at the start of each billing cycle. One-time credits do not expire and are consumed after subscription credits. Subscription licenses remain valid for the duration of the active billing period, while one-time credit licenses remain valid until all purchased one-time credits are used.
Offline Use
Speak2mail operates exclusively online and requires an active internet connection for its core features, including AI processing and Gmail integration. Offline use is not supported.
Accounts, Passwords, and Security
You can’t use the Service without registering. Registration is required to authenticate your account and accurately track your credit usage. You are responsible for keeping your account data secure, and you are solely and strictly liable for any activity that occurs under your username. You also agree not to access, or attempt to access, other Users accounts and/or data. If you wish to delete your account, simply send a request to support@speak2mail.com. Once we receive your request, your account and associated data will be permanently deleted from our systems within 30 days.
User Conduct and Responsibilities
Users are granted the freedom to utilize the Service in a manner they deem suitable, subject to the adherence to laws and regulations. However, Users are explicitly prohibited from engaging in any illegal activity using the Service.
Responsibilities
The Service may use artificial intelligence (AI) to generate text suggestions. You acknowledge that AI-generated content may contain inaccuracies or unintended language, and you agree to review all generated content before use. Users are solely responsible for reviewing and approving the content of all email texts created using Speak2mail. It is the User’s responsibility to ensure that messages do not contain harmful or inappropriate content before sending.
Liabilities
Speak2mail is not responsible for any user-generated content that includes hate speech, offensive language, or other prohibited material. Users are solely responsible for managing such content. While we aim to provide a safe and respectful experience, maintaining the appropriateness of email content is ultimately the User’s obligation.
Payment Terms
For Customers Using Free Plans
We do not require a payment method when using our free offering.
For Customers on Subscription Plans
If you are not satisfied with the Service, we will issue a refund for your first purchase within 30 days of that purchase. Subsequent purchases are not eligible for refunds. Subscription plans renew automatically at the end of each billing cycle unless cancelled through your account settings before the renewal date. Cancellation requests must be made directly through the Service.
For Customers with One-Time Credits
Refunds for one-time credits are available within 30 days of purchase only if the credits remain unused during that period.
Chargeback/Refund Policy
Eligible refunds will be issued to the credit card that was used to make the purchase. We will not issue cash refunds under any circumstances. If you have a question about charges made to your account, please contact us immediately. If the charges were made in error, we will credit your account for the appropriate amount. We have a zero tolerance policy for chargebacks. Any customer who disputes a credit card payment that is found to be valid will be permanently banned from using the Service.
Service Availability and Limitations
We are committed to ensuring that the Service is available to you with maximum reliability. While we strive to maintain an exemplary uptime record, it is important to acknowledge that unforeseeable circumstances may affect service availability.
Liability
The Service and the materials provided through the Service are available to you on an "as is" basis. To the fullest extent permitted by law, we expressly disclaim all warranties, whether express, implied, statutory, or otherwise, including, but not limited to, any warranties of merchantability, fitness for a particular purpose, and non-infringement of intellectual property rights. We, along with our suppliers, shall not be liable for any indirect, special, incidental, consequential, or punitive damages, including but not limited to, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) Your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use, or alteration of your content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage. Specifically, “consequential loss” encompasses any form of indirect loss, including, without limitation, loss of profit, revenue, business, goodwill, opportunity, or anticipated savings, whether arising under statute, contract, tort (including negligence), indemnity, or otherwise.
Statute of Limitations
You agree that regardless of any statute or law to the contrary, any claim or cause of action that you may wish to assert related in any manner to the Service must be filed within one (1) year after such claim or cause of action accrued or be forever barred. Right to Terminate
We may suspend or terminate your access to the Service, with or without notice, if you violate these Terms or engage in behavior that disrupts the Service. Upon termination, your right to use the Service will immediately cease.
Severability
If any provision or part of a provision of these Terms is unlawful, void, or unenforceable, that provision or part of the provision is deemed severable from these Terms and does not affect the validity and enforceability of any remaining provisions.
Miscellaneous
These Terms constitute the entire agreement between you and us relating to your access to and use of the Service. Any additional or different terms proposed by you in any purchase order, request for proposal, or other document are hereby objected to by us and shall be void. The failure of us to exercise or enforce any right or provision of these Terms will not operate as a waiver of such right or provision. The section titles in these Terms are for convenience only and have no legal or contractual effect. Except as otherwise provided herein, these Terms are intended solely for the benefit of the parties and are not intended to confer third party beneficiary rights upon any other person or entity. These Terms may not be assigned or transferred by you except with our prior written consent. These Terms may be executed and delivered electronically and in one or more counterparts, each of which shall, when taken together, constitute a single document.
